Hi my name's Kristen Johnson I am the qualified broker and co-owner of independence capital property management in Farmington New Mexico today I'm here to talk a little about how to handle lease violations it's important to take into consideration what type of violation you are dealing with if it's a substantial violation where a law has been broken domestic violence drugs things of that nature you would want to issue a 3-day notice of a substantial violation basically telling the tenant that they need to be removed from the property within three days if it's a less substantial violation just a common lease issue you would want to issue a seven-day notice of non-compliance giving the tenant time to correct the issue basically what we've seen most of is unauthorized occupants are unauthorized pets some ways that we find out about these violations are through vendor contact you know going out to do routine maintenance through a routine inspection noticing that there's additional bedding or clothing there beyond what we know is approved on the lease or people coming in to pay rent regularly who are not on a lease those would give us indications that there might be additional occupants at the property so in these cases you would want to issue that Notice of Violation giving them seven days to correct the issue and either remove the unauthorized person or pets or get them approved, and lastly you just want to make sure that you follow through and follow up, so you know follow up with an inspection make sure that the violation has been corrected and that you can all move forward smoothly if you have any questions about this please feel free to give us a call we'd love to help
